Governing Your Commissions and Purchases

1. Acceptance of Terms

Welcome to Pembarthy Metal Handicrafts, operating digitally as "Metal Artisan" (herein referred to as "we", "our", or "the atelier"). By accessing our website, commissioning an artwork, or engaging with our Heritage Metal Exchange Program, you agree to be bound by these Terms and Conditions. Please read them carefully before initiating any transaction.

If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any of our bespoke services.

2. Bespoke Commissions & Orders

Because every masterpiece crafted in our atelier is made entirely by hand using authentic 500-year-old repoussé and chasing techniques, the following terms apply to all orders:

  • Uniqueness: No two pieces are ever perfectly identical. Slight variations in finish, weight, and detail are inherent hallmarks of genuine human craftsmanship and are not considered defects.
  • Timelines: Estimated crafting timelines (typically ranging from 45 to 120 days) are approximations based on the scale of the artwork. Due to the rigorous, un-automated nature of our craft, delays may occur. We prioritize uncompromising museum quality over speed.
  • Non-Refundable: Due to the highly customized nature of bespoke commissions, once the design is approved and hammering begins, deposits and payments are strictly non-refundable.

3. Heritage Metal Exchange & Renovation

For patrons utilizing our Heritage Exchange or Renovation services, the following specific terms apply:

  • Valuation: Submitted brass or copper is evaluated solely on current raw material market value, weight, and metallurgical purity. Sentimental or antique value cannot be factored into the exchange credit.
  • Irreversibility: Once old metal is surrendered and credited towards a new commission, it is melted down to forge the new piece. This process is absolutely irreversible.
  • Renovation Constraints: For renovation services, we exercise the utmost care. However, working with ancient, brittle metal carries inherent risks. By submitting an heirloom for renovation, you acknowledge these risks.

4. Pricing & Payments

All prices, quotations, and estimates provided by our concierge are valid for a period of 14 days, after which they may be subject to recalculation based on fluctuating global metal costs.

For bespoke commissions, a standard non-refundable advance payment (typically 50%) is required before crafting begins. The remaining balance, including applicable shipping, insurance, and taxes, must be cleared in full before the masterpiece is dispatched from our atelier.

5. Shipping & International Customs

We successfully export our masterworks to collectors, estates, and temples globally. All artworks are shipped in custom-built, museum-grade wooden crates.

  • Insurance: All shipments are fully insured during transit. Upon delivery, the patron assumes full responsibility for the artwork.
  • Customs & Duties: For international clients, any import duties, customs tariffs, or local taxes levied by the destination country are the sole responsibility of the buyer.

6. Intellectual Property

The designs, motifs, architectural drawings, and photographic media created by Pembarthy Metal Handicrafts remain the exclusive intellectual property of the atelier. Commissioning a bespoke piece grants you physical ownership of the metal artwork, but does not transfer the copyright of the design unless explicitly agreed upon in writing.

Website content, imagery, and text may not be reproduced, duplicated, or exploited without express written consent from our management.

7. Returns & Cancellations

Given the bespoke, made-to-order nature of our craftsmanship, we do not accept returns, exchanges, or cancellations once production has commenced.

In the highly unlikely event that a piece arrives structurally damaged during transit, you must notify our concierge within 48 hours of delivery, retaining all original packaging and providing photographic evidence for the insurance claim process.

8. Governing Law & Jurisdiction

These Terms and Conditions, and any separate agreements whereby we provide you services, shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or related to these terms shall be subject to the exclusive jurisdiction of the courts in Jangaon District, Telangana, India.
